Update on Court Policy regarding Continuances

In response to comments from the bar at last Friday’s Bench-Bar meeting related to continuances, Department 1 will now grant a single 30-day continuance pursuant to Code of Civil Procedure section 595.2 (i.e., without good cause other than a stipulation) if the case is no more than 18 months old.  The new rule is as follows:

The Court will continue the trial without a showing of good cause (Code Civ. Proc., § 595.2) only under the following conditions:

  1. The current trial date is no more than 18 months after the filing date of the complaint;
  2. The trial date has not previously been continued for any reason;
  3. The requested continuance is for no more than 30 days; and
  4. A written stipulation by all parties and a proposed order has been submitted at least five court days in advance of the trial date.
